Payment for services is due as outlined in the service agreement between Seaside Pest Control and the customer. Refunds are issued only under the conditions specified in the agreement or under applicable consumer protection laws. Services may be suspended or terminated if payments are not made as required. There are no refunds for services rendered unless there is a failure to meet the agreed terms due to reasons outside of Seaside Pest Control’s control (e.g., force majeure events).

Seaside Pest Control reserves the right to modify or update these Terms at any time. Changes will be posted on this page, and the effective date will be updated. It is your responsibility to review the Terms regularly. Continued use of the website and services after any changes indicates your acceptance of the updated Terms.

15. Dispute Resolution

Any disputes arising from these Terms or the use of our services will be resolved through binding arbitration in accordance with the laws of British Columbia, Canada. In cases where mediation is required, Seaside Pest Control will engage in a good-faith effort to resolve disputes through a neutral third-party mediator. All parties shall equally share the costs of arbitration and mediation unless otherwise stipulated in the settlement.

16. Mass Arbitration Process Requirements

If 25 or more similar claims are asserted against Seaside Pest Control by the same or coordinated counsel, the resolution of your dispute might be delayed. In such cases, Seaside Pest Control and the claimants’ counsel will each select 10 cases to proceed to individual arbitration. Any remaining claims will follow a staged arbitration process, including mediation efforts overseen by a retired Canadian court judge. The arbitration process will comply with British Columbia arbitration law.

17. Severability

If any provision of these Terms is found to be unlawful or unenforceable, then that provision will be deemed severable from these Terms and will not affect the enforceability of any other provisions.

18. Waiver

The failure by us to enforce any right or provision of these Terms will not prevent us from enforcing such right or provision in the future.

19. Assignment

We may assign our rights and obligations under these Terms, including in connection with a merger, acquisition, sale of assets or equity, or by operation of law. You may not assign these Terms without our prior written consent.

20. Entire Agreement

These Terms constitute the entire agreement between you and Seaside Pest Control concerning the website and services. They supersede any prior agreements or communications between you and us, whether oral or written.

21. Force Majeure

Under no circumstances will we be held liable for any delay or failure in performance due in whole or in part to any acts of nature or other causes beyond our reasonable control, including but not limited to fire, flood, earthquake, pandemic, or governmental actions.

22. Governing Law

These Terms shall be governed by the laws of British Columbia, Canada, without reference to its conflict of laws or choice of law rules. Any action of whatever nature relating to these Terms will be filed only in the provincial or federal courts located in British Columbia. You consent and submit to the personal jurisdiction of such courts for the purposes of any such action.
