Acceptance of Terms: By accessing or using our website or services, you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, you must immediately cease use of the website and services.

Modification of Services and Terms: Seaside Pest Control reserves the right to modify, update, or discontinue any of our products, plans, or services at any time without prior notice to customers. This includes changes in service pricing, availability, features, and the terms of this agreement. Customers are encouraged to review our Terms of Use periodically for updates. Continued use of our services following any changes constitutes acceptance of the new terms and conditions.

Intellectual Property Rights: All content, materials, and intellectual property displayed on the Seaside Pest Control website, including text, graphics, logos, and images, are owned by Seaside Pest Control or its licensors. You are granted a limited, non-exclusive, revocable license to access and view the website for personal use only. You may not modify, reproduce, or redistribute any content without explicit written consent. Unauthorized use may result in legal action.

Privacy Policy: Seaside Pest Control is committed to protecting your privacy. We collect, store, and process personal information in accordance with applicable laws, including British Columbia’s Personal Information Protection Act (PIPA). You can review our detailed Privacy Policy. This policy governs how we collect, use, and share personal information and explains your rights concerning your data.

SMS Communications / SMS Campaigns Policy: By providing your phone number and using our services, you acknowledge and consent to the terms of our SMS Campaigns, which governs:

• Consent and opt-in requirements under CASL (Canada) and TCPA (US) laws

• Differentiation between mandatory service messages and optional marketing messages

• Message types, frequency, confirmation messages, and dynamic updates

• Opt-out instructions and help instructions

• Retention of SMS data (minimum 3 years as required by law)

• Data use and disclosure policies

Use of the Website: You agree not to use the website for any unlawful purpose or in violation of these Terms. You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account. Prohibited uses include, but are not limited to: unauthorized access or interference with the website or services; use of automated scripts, bots, or scraping tools; submission of content that violates privacy, spam, or intellectual property laws. Use of SMS communications constitutes agreement to the SMS Campaigns Policy.

Disclaimers: The website and services are provided “as is” and “as available.” Seaside Pest Control makes no warranties or representations, either express or implied, regarding the website, services, or content. This includes the accuracy, reliability, or completeness of information. We disclaim liability for damages arising from use or inability to use the website, including service interruptions, data loss, or unauthorized account access.

Limitation of Liability: Seaside Pest Control shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, even if advised of the possibility of such damages. Our total liability in any matter related to these Terms shall not exceed the fees paid for services rendered in the last 12 months.

Indemnification: You agree to indemnify, defend, and hold harmless Seaside Pest Control, its affiliates, directors, officers, employees, and agents from and against all claims, losses, damages, liabilities, and costs, including legal fees, arising out of or related to your use of the website or services, violation of these Terms, or infringement of any intellectual property or other rights. You will cooperate as required in the defense of any claim.

Fees and Payment: Payment for services is due as outlined in the service agreement. Refunds are issued only under conditions specified in the agreement or under applicable consumer protection laws. Services may be suspended or terminated if payments are not made as required. No refunds are provided for services rendered unless there is a failure to meet agreed terms due to circumstances beyond Seaside Pest Control’s control (e.g., force majeure). Recurring Payments / AutoPay: Where applicable, you may enroll in automatic recurring payment options for services. Terms of such billing will be disclosed at the time of enrollment.

Modifications: Seaside Pest Control reserves the right to modify or update these Terms at any time. Changes will be posted on this page, and the effective date will be updated. Continued use of the website or services after any changes indicates acceptance of the updated Terms.

Additional Terms: Certain services may be governed by additional terms. Such terms will be disclosed at the time of use and are incorporated by reference into these Terms.

Third-Party Links: Our website may contain links to third-party websites or services. These links are provided for convenience only. Seaside Pest Control has no control over the content or practices of these sites and is not responsible for availability, accuracy, or any products/services offered by third parties.

User-Generated Content: By submitting content to the website, you grant Seaside Pest Control a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works, and display such content. You represent and warrant that you have the right to grant this license and that your content does not violate any third-party rights or laws.

Termination: Seaside Pest Control may terminate or suspend your access to the website at any time, without notice, for any reason, including violation of these Terms. Upon termination, all licenses and rights granted to you will cease immediately.

Dispute Resolution | Arbitration: Any disputes arising from these Terms or use of our services shall be resolved exclusively through binding arbitration in accordance with the laws of British Columbia, Canada. This arbitration provision does not attempt to waive any mandatory consumer rights under applicable law. Where mediation is required, Seaside Pest Control will engage in a good-faith effort to resolve disputes through a neutral third-party mediator. Costs of arbitration and mediation are shared equally unless otherwise stipulated.

No Class or Representative Claims: You agree that all disputes will be resolved individually and not as part of a class, consolidated, or representative action.

Mass Arbitration | Multiple Claims: If 25 or more similar claims are asserted by the same or coordinated counsel, resolution may be delayed. In such cases, Seaside Pest Control and the claimants’ counsel will each select 10 cases to proceed to individual arbitration. Remaining claims will follow a staged arbitration process, including mediation overseen by a retired Canadian court judge, in compliance with British Columbia arbitration law.

Severability: If any provision is found to be unlawful or unenforceable, it will be deemed severable and will not affect the enforceability of other provisions.

Waiver: Failure by Seaside Pest Control to enforce any right or provision does not prevent future enforcement of that right or provision.

Assignment: Seaside Pest Control may assign its rights and obligations under these Terms, including in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without prior written consent.

Entire Agreement: These Terms constitute the entire agreement regarding the website and services, superseding any prior agreements or communications.

Force Majeure: Seaside Pest Control is not liable for delays or failures due to acts of nature or causes beyond reasonable control, including fire, flood, earthquake, pandemic, or governmental actions.

Governing Law / Courts: These Terms are governed by the laws of British Columbia, Canada, without reference to conflict-of-law rules. Any claims not covered by arbitration must be brought only in provincial or federal courts located in British Columbia. You consent to the jurisdiction of such courts.
